Vehicle Listing Rules

These Vehicle Listing Rules (the "Rules") govern the rights and obligations relating to the creation, verification, publication and removal of listings for second-hand motor vehicles on the tamkonum platform. The platform is operated by BM İNTERNET MAĞAZACILIK VE ELEKTRONİK TİCARET HİZMETLERİ LİMİTED ŞİRKETİ ("tamkonum", the "Company", "we").

These Rules form an integral part of the Terms of Service, the Community Guidelines, the KVKK Disclosure and the Privacy Policy. By creating a vehicle listing on the platform you declare that you have read and accepted these Rules.

1. Purpose, Legal Basis and Definitions

These Rules explain how the obligations imposed on listing platforms by the Regulation on the Trade of Motor Vehicles (the "Regulation"), published in the Official Gazette No. 32645 of 27 August 2024, are applied on tamkonum.

Vehicle: a registered second-hand motor vehicle within the scope of the Regulation (car, SUV, motorcycle, commercial vehicle, caravan and similar).
Vehicle Listing: a record consisting of video, information and declarations uploaded to the Platform for the sale of a Vehicle.
Private Seller: a natural person who lists, without carrying out a commercial activity, a Vehicle owned by themselves, their spouse or a first or second degree blood relative.
Dealer: a natural or legal person holding a second-hand motor vehicle trade licence and having a verified business account on the Platform.
Licence: the second-hand motor vehicle trade licence issued by the Ministry of Trade under the Regulation.
EİDS: the Electronic Listing Verification System of the Republic of Türkiye Ministry of Trade.
Ministry: the Republic of Türkiye Ministry of Trade.

2. Who May Create a Vehicle Listing

Under the Regulation, a Vehicle Listing may only be created by:

the owner of the Vehicle, as named in the registration record;
the owner's spouse and first and second degree blood relatives (parents, children, siblings, grandparents, grandchildren);
a Dealer holding a valid Licence and authorized by the owner via e-Devlet.

Ownership and kinship are verified automatically against Ministry records; no additional document is required. Dealer authorization is granted by the owner through the e-Devlet service "EİDS Vehicle Listing Authorization", using the Dealer's Licence number and for a period of at least 90 days. A spouse or blood relative cannot authorize a Dealer on behalf of the owner.

Selling more than three Vehicles within a calendar year is deemed a commercial activity under the Regulation and requires a Licence. The Platform shows a warning when a Private Seller creates a third Vehicle Listing in the same year; responsibility for exceeding this limit rests with the listing owner.

2A. Dealer Verification, Document Declaration and Recourse

To create a Vehicle Listing as a Dealer, the business account must be verified on the Platform. The following are submitted for verification:

e-Devlet identity verification of the authorized person acting on behalf of the business;
the Licence;
a current tax certificate;
a chamber of trade or professional chamber registration certificate;
for legal entities, the trade registry gazette;
a location seal taken through the app at the business address.

A vocational qualification certificate may be submitted optionally and is shown as a badge on listings.

Declaration and notification obligation. The Dealer accepts that the documents it submits are genuine, valid and its own, and that it will notify the Platform within thirty days at the latest of the cancellation, suspension or expiry of its Licence and of any change in its trade name, address, tax number or authorized person.

Nature of the review. tamkonum reviews the submitted documents on their face; it gives no guarantee of accuracy on behalf of the issuing authority. The actual determination of authority rests with the Ministry; the Ministry query performed on the Dealer's first Vehicle Listing separately confirms the tax number and the Licence number.

Recourse. Where forged, invalid, expired or third-party documents are submitted, or where listings continue to be created although the conditions of the Licence are no longer met, the Dealer's listings are removed, its account may be suspended or closed, and the matter is reported to the Ministry. tamkonum reserves the right of recourse against the Dealer and the authorized person who carried out the transaction for any loss, administrative fine and cost it incurs as a result.

Location seal. The location of a Dealer's listings comes from the location seal taken at the business address. When the seal expires, the Dealer's listings are not shown to buyers until it is renewed.

2B. Who Owns the Listing: Private or on Behalf of the Dealer

A person may, with the same account, both be a team member of a Dealer and list, as a private seller, a Vehicle owned by themselves, their spouse or their relatives. Who the listing is created on behalf of is determined by the type of EİDS verification performed during listing; the role selected on the account is not decisive on its own.

A listing created with "Own / Relative" verification is a private listing. The listing is in the name and under the responsibility of the person who created it; the Dealer is neither a party to nor responsible for this listing. The listing does not count towards the Dealer's listing allowance; the Dealer's name, address and Licence number do not appear on it; the location is shown at province and district level.
A listing created with "As a Dealer" verification is a listing on behalf of the Dealer. It is published with the Dealer's Licence number, trade name and business address. The Dealer and the authorized person who carried out the transaction are jointly responsible for such listings.
The person is obliged to select correctly which Dealer they are acting on behalf of during verification; creating a listing on behalf of a Dealer without authority is a breach under Section 6.
When team membership ends, listings the member created on behalf of the Dealer remain with the Dealer and under its management; the member's private listings are not affected.

3. Identity and Authorization Verification (EİDS)

Before a Vehicle Listing can be created, the identity and phone number of the listing owner are verified; identity verification is performed through EİDS via e-Devlet.
For every Vehicle Listing, a Ministry query is made with the Vehicle's plate before publication and the listing owner's authorization for that Vehicle is confirmed. A listing cannot be published for a Vehicle whose authorization cannot be confirmed.
If the Ministry verification fails, the Platform explains the reason as clearly as possible. If no authorization is found, the owner of the Vehicle may create the listing with their own account.
Make, trade name and model year are taken from Ministry records, written into the listing by the Platform and cannot be changed by the listing owner (Article 21 of the Regulation).
During verification only the EİDS user code, the plate and, where applicable, the Dealer's tax number and Licence number are transmitted to the Ministry. Details are set out in the KVKK Disclosure.

4. Listing Content

A Vehicle Listing must be accurate, current and complete. The listing owner is responsible for the accuracy of all information and declarations in the listing.

Mandatory information: make, trade name and model year (from the Ministry record), mileage, fuel and transmission type, sale price and currency, and the other information required by the Regulation.
Damage, paint and replaced parts: the Vehicle's known damage history, painted and replaced parts and any heavy damage record must be clearly stated. Omitting or concealing this information constitutes a misleading listing.
Mileage: the true mileage must be stated. Concealing known tampering with the odometer is prohibited.
Inspection report: an expert inspection report may be attached if available; its date and scope must be stated correctly.
Images and video: uploaded videos and photos must belong to the listed Vehicle and be current and genuine. Images of another vehicle, taken from the internet or edited to mislead are prohibited.
Plate: the plate is mandatory when creating a listing and is used for verification. In Private Seller listings the plate is not shown to buyers; in Dealer listings it is shown as required by the Regulation. The listing owner may choose to keep the plate out of frame in the video.
Price: the listing price is the genuine sale price valid at the time of listing; misleadingly low prices, empty price fields such as "call for price" or deliberate concealment of the price are prohibited.

5. Temporary Rules and Pre-Publication Warning

Under the transitional provisions of the Regulation, until 1 January 2027:

A second-hand Vehicle may not be offered for sale for commercial purposes, and no listing may be created for it, before six months have passed since its registration and 6,000 kilometres have been driven.
A second-hand Vehicle may not be listed at a price above the current recommended retail price set by its manufacturer or distributor.

The Platform reminds the listing owner of these rules before a Vehicle Listing is published. Listings that breach these rules are removed and, where necessary, reported to the Ministry. If the duration of these provisions is extended or amended by legislation, the Platform applies the current rule.

6. Prohibited Listings and Conduct

The following are prohibited and lead to removal of the listing and account sanctions:

creating a Vehicle Listing without authorization, or listing another person's Vehicle without permission;
opening more than one listing for the same Vehicle, or reopening a closed listing to circumvent the rules;
listing Vehicles that do not exist, have already been sold or are not offered for sale;
misleading declarations regarding damage, mileage, model year or equipment;
listing stolen, seized or legally unsaleable Vehicles; liens and seizure records must be disclosed in the listing;
practices that force the buyer to pay outside the Platform, such as redirecting off-platform or demanding advance payments or deposits;
sharing images of plates, chassis numbers or documents in a manner that violates the rules.

7. Role of the Platform and Liability

tamkonum is a hosting provider within the meaning of Law No. 5651 and Law No. 6563. tamkonum is not a vehicle trader, a Dealer, an intermediary or a party to the sale.
Transfer of the Vehicle, notary procedures, payment and delivery take place outside the Platform and between the parties. tamkonum is not a party to these transactions and cannot be held liable for them.
Ministry verification confirms the listing owner's authorization to list that Vehicle; it does not constitute any guarantee by the Platform regarding the Vehicle's damage history, mileage, freedom from defects or the appropriateness of its price.
Before purchasing, the buyer is responsible for obtaining an expert inspection, checking damage and mileage records and completing the notary transfer in person.
As required by the Regulation, the Platform provides listing and listing-owner information to the Ministry upon request, evaluates complaints and applies the notice-and-takedown procedure.

8. Listing Duration, Re-verification and Removal

For listings created by the owner or their relatives, the publication period is 90 days; if the listing is to be renewed at the end of this period, authorization is verified again.
For Dealer listings, the publication period is limited to the authorization period set by the owner in e-Devlet. When the authorization expires, the listing cannot remain published without re-verification.
The Platform re-verifies the authorization of published Vehicle Listings with the Ministry at regular intervals. If it is found that the authorization has been revoked or has expired, or that the Vehicle has changed hands, the listing is removed.
The owner may revoke the authorization granted to a Dealer via e-Devlet at any time; once the revocation reaches the Platform through a Ministry notification or re-verification, the listing is removed.
Listings for sold Vehicles must be closed by the listing owner without delay.

9. Retention of Records

Under the Regulation, the listing owner's identity and phone verification records, EİDS authorization results and listing records are retained for five years after the listing is removed from publication and are shared with competent authorities upon request. Details of the processing of this data are set out in the KVKK Disclosure and the Privacy Policy.

10. Paid Services and Other Programs

The terms of paid packages offered to Dealers, including payment, withdrawal and refund provisions, are governed by the Preliminary Information Form and the Distance Sales Agreement.
The Listing Points Program covers property listings only; Vehicle Listings and Dealer businesses are outside the scope of this program. Any change of scope will be announced separately.
Presenting a Vehicle in a live stream is subject to the Live Stream Rules.

11. Sanctions

In the event of a breach of these Rules, the Company may, depending on the severity of the breach, remove the listing, restrict listing rights, suspend or permanently close the account and report the matter to the Ministry and other competent authorities. Sanctions apply in addition to our other rights under the Terms of Service.

12. Amendments and Entry into Force

These Rules may be updated due to changes in legislation or in the operation of the Platform. The current version is published on the Platform; material changes are announced before publication. The Rules apply to all Vehicle Listings created on or after the effective date.
