TERMS OF SERVICE

1. Parties and Definitions

These Terms of Service ("Terms") govern the legal relationship between BM İNTERNET MAĞAZACILIK VE ELEKTRONİK TİCARET HİZMETLERİ LİMİTED ŞİRKETİ ("tamkonum", the "Company", "we"), whose details appear below, and the natural or legal person using the tamkonum platform (the "User", "you").

Definitions

  • Platform: The tamkonum mobile application, website and all related digital services.
  • Content: All text, images, video, audio, listing information, location data and other materials published on the Platform.
  • Listing: A property, vehicle or business record uploaded to the Platform by a User for the purpose of sale, rental or promotion.
  • Listing Owner: The User who creates a Listing and is responsible for its content.
  • Business/Agent Account: An account type opened for professional use that may include team and portfolio management.
  • Paid Digital Services: Services offered for a fee, such as subscriptions, listing boost, live broadcast packages and project advertising.

2. Description of the Service

tamkonum is a vertical-video-based, multi-category (residential, commercial, land, vehicle, restaurant, hotel) real estate and listing discovery platform. The Platform provides, among others, the following functions:

  • Creation of video and photo listings, AI-assisted feature extraction and location verification;
  • Search, personalized feed and map-based discovery tools;
  • Live-streamed property tours;
  • Messaging between buyers and businesses, in-app voice calls (which may be recorded) and appointments;
  • Business/agent profiles, team management and portfolio/CRM tools;
  • Paid Digital Services (subscription, boost, live broadcast package, project advertising).

2.1. Hosting Provider Status — Not an Intermediary

tamkonum is a hosting provider within the meaning of Law No. 5651. tamkonum is not a real estate broker, property consultant, intermediary or party. The Platform merely provides the technical infrastructure enabling Users to publish Content and communicate with one another.

  • The Listing Owner is solely responsible for the accuracy, currency and lawfulness of Listing content.
  • tamkonum is not a party to any purchase, sale, rental or service agreement concluded between Users.
  • The Platform does not provide escrow services; payment, delivery and contractual obligations rest entirely with the parties.
  • tamkonum cannot be held liable for disputes between parties, or for the quality, defects or failure of any property or service to meet expectations.

3. Membership and Account Security

  • You must be at least 18 years old to register on the Platform.
  • Membership is established via a phone number and SMS verification ("phone verification").
  • You are responsible for ensuring that the information you provide is accurate, current and complete.
  • You are responsible for securing your account and verification access. You are deemed responsible for all transactions carried out through your account.
  • If you notice unauthorized use of your account, you must notify us immediately at kvkk@tamkonum.com / destek@tamkonum.com.
  • A User may create more than one business/agent account belonging to them; however, creating an account with a false identity or on behalf of another person is prohibited.

4. User Obligations and Prohibited Uses

When using the Platform, you agree to comply with applicable legislation, these Terms, the Community Guidelines and the Live Broadcast Rules. The following conduct is prohibited:

  • Publishing Content contrary to the law, public order, general morality or the rights of third parties;
  • Sharing false, misleading, fraudulent or untrue information/listings;
  • Infringing the intellectual property, personality or privacy rights of others;
  • Engaging in spam, unsolicited advertising, fraud or unlawful marketing activity;
  • Producing content involving hate speech, violence, harassment, discrimination, obscenity or child exploitation;
  • Using software, bots, scraping or reverse-engineering methods that threaten the security, integrity or operation of the Platform;
  • Acting without authorization on behalf of another person or entity, or impersonating others;
  • Misusing the in-app voice call, messaging or live broadcast features.

tamkonum reserves the right to remove Content and/or suspend accounts in the event of a breach of these rules.

5. Listing Rules

Every User who creates a Listing is obliged to comply with the following rules:

  • Accurate and current information: The price, characteristics, square meterage, location and all descriptions in the Listing must reflect the truth.
  • Genuine images and video: Uploaded photos and videos must belong to the property concerned and be current and genuine. Misleading, third-party or manipulated images are prohibited.
  • Location accuracy: The stated location must reflect the actual location of the property concerned.
  • Authority: The Listing Owner must have the authority to publish the property or service listed.
  • Prohibited content: Unlawful, fake, duplicate, misleading listings or listings infringing third-party rights are prohibited.

tamkonum is not obliged to pre-screen listings; however, it may remove listings that violate the rules upon notification or on its own initiative.

6. Intellectual Property

6.1. Rights Belonging to tamkonum

The tamkonum brand, logo, software, design, interface, database and all components of the Platform belong to tamkonum or its licensors and are protected by intellectual property legislation. Unless expressly permitted, copying, reproducing, distributing or creating derivative works from these elements is prohibited.

6.2. User Content and License

You retain ownership of the Content (video, photos, text, etc.) you upload to the Platform. However, by uploading Content, you grant tamkonum a worldwide, royalty-free, transferable and sublicensable, non-exclusive license to use, reproduce, process, store, display and distribute such Content for the purposes of providing, promoting and improving the Platform.

  • You represent and warrant that you hold all rights and powers necessary to publish the Content.
  • When you remove Content, this license terminates on a forward-looking basis; however, it may continue for a reasonable period within the scope of backup and statutory retention obligations.

7. Live Broadcast and In-App Communication

  • The live broadcast feature may be used solely for the purpose of property promotion and is subject to the Live Broadcast Rules.
  • Messaging, appointment and in-app voice call features must be used in accordance with the Community Guidelines.
  • In-app voice calls may be recorded for purposes of quality, safety and dispute resolution. By continuing the call, you are deemed to consent to such recording. Processing of recordings is subject to the Privacy Policy and the KVKK Disclosure Statement.
  • tamkonum reserves the right to terminate broadcasts that violate the rules and to restrict communication features.

8. Paid Digital Services and Payment

  • tamkonum offers digital services for a fee, such as subscriptions, listing boost, live broadcast packages and project advertising.
  • The fees, scope and conditions of these services are separately notified at the time of purchase through the Preliminary Information Form and the Distance Sales Agreement; these documents form an integral part of these Terms.
  • Payments are collected via the Tosla infrastructure using 3D Secure. Your card details are not stored by tamkonum.
  • The right of withdrawal, performance and refund conditions for digital services are governed by the Distance Sales Agreement. For digital content/services performed instantly and whose performance has commenced with the consumer's consent, there may be no right of withdrawal to the extent provided by the legislation.
  • Sharing of leads (inquiries) with developers/project owners is carried out only with the explicit consent of the User.

9. Continuity, Modification and Interruption of the Service

tamkonum reserves the right to develop, modify, update, and partially or fully suspend the Platform at any time. Interruptions in service may occur during maintenance, technical failure, updates or force majeure events. tamkonum does not guarantee that the Platform will be uninterrupted, error-free or always accessible.

10. Limitation of Liability and Disclaimer of Warranties

  • The Platform is provided "as is" and "as available"; tamkonum makes no express or implied warranty as to the accuracy of Content, the genuineness of Listings or fitness for a particular purpose.
  • tamkonum is not responsible for transactions between Users, Listing content, third-party Content, or decisions made in reliance thereon.
  • To the maximum extent permitted by applicable law, tamkonum shall not be liable for indirect, incidental, special or consequential damages or for loss of profit/data/reputation.
  • This clause does not affect liabilities that cannot be limited under the legislation (intent, gross negligence, consumer rights).

11. Indemnification

You agree to be liable for, and to indemnify tamkonum against, any and all damages, claims, lawsuits, costs and attorney's fees incurred by tamkonum or third parties as a result of your breach of these Terms, the legislation or the rights of third parties.

12. Suspension and Termination of the Account

  • tamkonum may suspend or terminate your account without notice and remove your Content in the event of a breach of these Terms or the relevant rules.
  • You may close your account at any time; account deletion requests are subject to the procedure set out in the Privacy Policy.
  • Upon termination, rights relating to paid services are determined in accordance with the provisions of the Distance Sales Agreement.
  • Provisions which by their nature must survive termination (intellectual property, limitation of liability, indemnification, dispute resolution) shall remain in effect.

13. Hosting Provider Liability, Complaints and Content Removal (Notice-and-Takedown)

  • tamkonum is a hosting provider within the meaning of Law No. 5651 on Regulating Broadcasts on the Internet and Combating Crimes Committed Through Such Broadcasts, and has no obligation to monitor published Content.
  • If you encounter Content that infringes your rights, you may send a notice to iletisim@tamkonum.com stating the nature of the infringement, the link to the relevant Content and your demands (notice-and-takedown).
  • tamkonum may, within a reasonable time, evaluate and remove or block access to Content that is manifestly unlawful or found to infringe rights.
  • Duly issued decisions of judicial or administrative authorities are implemented immediately.

14. Protection of Personal Data

The principles regarding the processing of your personal data are set out in the Privacy Policy and the KVKK Disclosure Statement. By using the Platform, you acknowledge that you have read these documents. For requests regarding your data, you may contact kvkk@tamkonum.com.

15. Commercial Electronic Messages

Within the scope of Law No. 6563 on the Regulation of Electronic Commerce, commercial electronic messages for campaign, promotional and informational purposes are sent only with your consent. You may withdraw this consent free of charge at any time by using the opt-out option within the message or by contacting iletisim@tamkonum.com.

16. Force Majeure

tamkonum cannot be held liable for delays in or impossibility of performance arising from events beyond its reasonable control, such as natural disasters, fire, epidemics, war, terrorism, cyber-attacks, infrastructure or communication outages, or governmental decisions.

17. Governing Law and Dispute Resolution

  • These Terms are governed by Turkish law.
  • For Users qualifying as consumers, the Consumer Arbitration Committees and Consumer Courts have jurisdiction within the monetary limits set out in the legislation.
  • For all other disputes, the Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction.

18. Amendments and Effectiveness

  • tamkonum may update these Terms at any time. The current version takes effect upon being published on the Platform.
  • For material changes, Users are informed by appropriate means.
  • Your continued use of the Platform after a change constitutes your acceptance of the updated Terms.
