What determines the rent increase? (TBK 344)
Turkish Code of Obligations art. 344: increase agreements for renewed periods are valid only up to the 12-MONTH AVERAGE change in CPI for the previous rental year. This differs from 'annual inflation': the annual change compares a single month to a year earlier (June 2026: 32.11%), while the 12-month average compares the last 12 months' average to the previous 12 (32.03%) — rent uses the SECOND.
Which month's data? By established practice, a contract renewed in month X uses the data of month X−1 — because TÜİK announces each month's data around the 3rd of the following month. Example: July renewal → June data (32.03%). The day of the month does not change the rate.
Is the 25% cap over?
Yes. The temporary 25% cap on housing rents (11 June 2022 – 1 July 2024, TBK Provisional arts. 1-2) has expired, and no new cap was introduced in 2025-2026. Since 1 July 2024 the single rule for both housing and commercial premises is the 12-month average CPI. (The 25% cap never applied to commercial premises.)
What if the landlord demands more than the cap?
Agreements exceeding the cap are INVALID as to the excess — a tenant who pays the legally increased amount has fulfilled their obligation, and refusing an above-cap increase alone is not grounds for eviction. If the contract has no increase clause, there is no automatic increase; failing agreement, a judge sets the rent (capped by CPI). Mid-year increases cannot be demanded, and no other contract change may be made against the tenant (TBK 343).

After 5 years: rent determination lawsuit
TBK 344/3: in contracts longer than five years or renewed after five years (and every five years thereafter), either party may file a rent determination lawsuit; the judge sets the rent WITHOUT being bound by the CPI cap — considering CPI, the property's condition and comparable rents, in equity. So after year 5, rent can be moved to market level. If filed at least 30 days before the new period (or after written notice within that window), the ruling applies from the start of the new period.

The legal cap is the 12-month average CPI change of the month before renewal. For a July 2026 renewal that's 32.03%: a 30,000 ₺ rent can rise to at most 39,609 ₺. A lower contractual rate prevails.
What is this month's rent increase rate?

What does '12-month average CPI' mean?
The ratio of the last 12 months' index average to the previous 12 months' average. Often confused with 'annual inflation' (a single month vs a year earlier): in June 2026 the annual rate was 32.11% while the 12-month average was 32.03% — rent uses 32.03%.
Can the landlord raise rent by 75%?
No. Any increase above the legal cap (July 2026: 32.03%) is invalid as to the excess. A tenant paying rent increased at the legal rate has fulfilled their obligation. After 5 years the landlord may seek market rent only via a rent determination lawsuit — decided by a judge.
Can missed increases from past years be charged at once?
A single 'accumulated' jump cannot be applied; the widely accepted method is applying each period's own cap sequentially (compounding). Example: after 2 missed years, apply the first year's rate, then the second year's rate on the result. Seek legal advice for your case.
Is an increase mandatory if the contract has no increase clause?
There is no automatic increase. Parties may agree; failing that, a judge sets the rent capped by the 12-month average CPI (TBK 344/2). The landlord cannot impose an increase unilaterally.
When does the increase apply — can it change mid-month?
The increase applies with the new rental year at renewal. The rate is the TÜİK figure of the month before the renewal month; the day of renewal doesn't change it. No interim increase may be demanded before the rental year ends.
Can foreign-currency rent be increased?
In foreign-currency leases no change may be made to the rent for 5 years (TBK 344/4). Separately, agreeing rent in foreign currency between Turkish residents is generally prohibited for housing/commercial leases (Decree 32; exceptions in the communiqué).
Can a tenant reclaim overpaid increases?
Amounts paid above the cap are legally invalid, so they can be reclaimed under unjust enrichment rules. Time limits and procedure depend on the case — consult a lawyer.
